Before you start an eviction

  •  Confirm the lease type (written, month-to-month, expired) and the correct tenant names.
     
  • Pull your ledger (rent due, payments received, late fees—dates matter).
     
  • Gather the lease, addenda, and any notices already served.

Serve the correct notice

  •  Nonpayment: serve a 3-Day Notice (rent only)
     
  • Lease violation: serve the correct 7-Day Notice (with/without cure)
     
  • Holdover: serve the proper termination notice for month-to-month or expired term
    (If you’re not sure which applies, start online and we’ll confirm the correct category.)

Don’t accidentally delay your case

  • Don’t accept partial rent after notice without a plan (can complicate the filing).
     
  • Keep communications professional and save texts/emails.
     
  • Avoid “self-help” (lockouts, shutoffs).

How the eviction process works (At Our Office)

1. Start Online (7 minutes)

Complete the Start an Eviction Online form and upload your lease, notice, and ledger. 

2. We Review for compliance and next steps

We confirm the eviction type (nonpayment, lease violation, holdover, unlawful detainer) and make sure the notice/service details won’t cause avoidable delays. 

3. We file and serve the case

We prepare and file the lawsuit and coordinate service of process. 

4. Default or hearing—then final judgment.

If the tenant doesn’t respond, we move for default when permitted; if contested, we prepare for hearing and guide you through the timeline. 

5. Writ of possession and turnover.

After judgment, we handle the steps toward writ/possession so you can regain the property as quickly as the process allows. 

6. All updates in MyCase.

We use the MyCase Client Portal for secure messaging, document sharing, invoices/payments, and case updates—so everything stays organized in one place.

Non-payment of rent

 Used when rent is not paid on time. The right notice and an accurate ledger prevent delays and help move the case quickly. 

Lease Violation

 Used for material lease violations (other than rent). The notice type depends on whether the issue can be cured; documentation matters. 

Holdover Tenants

Used when the lease term ends or a month-to-month tenancy is terminated and the tenant won’t vacate. Timing and the correct termination notice are key.

Holdover Tenants

Unlawful Detainer

Used to remove an occupant when there may not be a traditional landlord-tenant relationship (e.g., guest, family member, significant other). The procedure is different than a rent eviction and must be filed correctly.
